GENERAL TERMS AND CONDITIONS AND PRIVACY POLICY
FOR THE USE OF THE KUCHA APPLICATION

Introduction
Welcome to the Kucha application, developed for property management, rental relationships, and community management for residential or other types of communities. This document represents the general terms and conditions for using the Kucha mobile application (hereinafter referred to as "Kucha Mobile App") and the Kucha Communities web application (hereinafter referred to as "Kucha Communities Web").
By using the Kucha Mobile App, you agree to these terms and conditions. If you do not agree with them, please discontinue use of the application.
Application Operator
The Kucha Mobile App is operated by KUCHAAPP d.o.o., with its registered office at Sokolska ulica 46, 2000 Maribor, company registration number: 9392670000, tax number: 68680546, registered in the Commercial Register of the District Court in Maribor with a share capital of EUR 8,064.55. The company is responsible for the operation of the application, data processing, and providing user support.
Creating a User Account
Registration: To use the Kucha Mobile App, the user must first create a user account. An email address and password are required for registration.
Verification: After registration, a confirmation email will be sent to the user. The user must confirm their email address by clicking the "Confirm" link in the received message.
Profile Completion: After confirming the email address, the user can complete their profile with personal information, including their name, surname, address (street, house number, country, region – optional). Profile completion is not mandatory to access the Kucha Mobile App. However, it is required before adding properties, as outlined in Article 4.1 of these general terms and conditions.
Property Management and Invitations
Adding Properties: Users can create one or more properties in the application, customize them with a chosen name (Custom Name), and enter the property address (street, house number, city, country, region – optional).
Inviting Other Users: The user (property owner) can invite other individuals to manage the property in the roles of “tenant,” “resident,” or “authorized person.” When inviting a user as a tenant, the owner specifies the rental duration (start and end dates). If the invited person is not already in the user’s contacts, the invitation is sent via email.
Accepting the Invitation: When the invited user accepts the invitation, they are added as a tenant, authorized person, or resident of the property. The owner can then share events with them and communicate with them through the application.
Payments and Stripe Verification for Rental Agreements
5.1. Verification: To process payments, both the owner and tenant must first complete Stripe verification. Verification is done by following a link to the provider's Stripe website and entering the required information (such as whether the user is an individual or a company, their name, surname, date of birth, address, country, nationality), and uploading the necessary documents along with their bank account and credit card details.
Kucha does not store this data. All data is processed as described in the Stripe Privacy Policy.
Once all data is entered, the verification status is marked as pending, and users are redirected back to the Kucha app. Once verification is completed, rent payments can be set up and the wallet feature can be used.
Verification is conducted via the website https://stripe.com/en-ca/connect/onboarding.
5.2. Rent Setting: The owner sets the rent amount, billing cycle, and billing method (prepayment or retroactive), to which the tenant must agree. Once these terms are set and agreement is given, payments can begin.
5.3. Stripe Fees: During the beta phase, the Kucha Mobile App service will not charge any fees. Users will only bear the Stripe fees for processing payments according to the Stripe pricing list available at https://stripe.com/connect/pricing.
Managing Events, Tasks, and Reminders
The application allows the creation and management of events, tasks, and reminders through an integrated calendar. The user can invite other people to events and add links for online meetings through a text field.
Connection to Kucha Communities Web
The Kucha Mobile App will be connected to Kucha Communities Web, enabling participation in communities (such as residential communities or property owner associations). The president or manager can invite users to the Kucha community.
Kucha Communities Web
Community Management: Kucha Communities Web allows the management of various communities, such as property owner associations, multi-unit buildings, and residential communities.
Access Levels: The application provides different levels of access and rights, including community owner, community admin, community board member, and community member.
Communication: Community members can communicate with each other, submit suggestions for improvements, share documents, and organize votes. The community president or board can share documents with all members.
Membership Fee Payments: The application enables the payment of membership fees via Stripe and allows monitoring of payment statuses. During the beta phase, no additional fees will be charged, except for Stripe fees.
Connection to Kucha Mobile App
All communities, events, and documents shared via Kucha Communities Web will also be accessible to users of the Kucha Mobile App if they accept an invitation from the community president or manager.
Data Protection
KUCHAAPP d.o.o. is committed to handling users' personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the Personal Data Protection Act (ZVOP-2).
All personal data provided by the user through the Kucha application will be processed lawfully, fairly, and transparently, for purposes that are clearly defined and lawful, and to the extent necessary to fulfill those purposes. The user has the right to access, rectify, delete, and restrict the processing of personal data, as well as the right to object and data portability, as provided in the GDPR.
Cookie Policy
The Kucha application and Kucha Communities Web use cookies to improve the user experience and provide better functionality. Cookies are small text files stored on your device by the website or application, enabling it to recognize your settings, collect analytical data, and provide security during use.
Types of Cookies We Use:
Essential Cookies: These cookies are essential for the operation of the application, allowing you to use basic features such as accessing secure areas and managing your user account.
Analytical Cookies: These cookies collect anonymous information about how users use the application, helping us improve functionality and user experience.
Functional Cookies: These cookies enable the application to remember your choices (such as language settings) and provide a more personalized user experience.
Managing Cookies: Users can control and manage cookies through their browser or application settings. Users can decline the use of cookies, but this may affect the functionality of the application and website.
Consent to Use Cookies: By continuing to use the application or website, you consent to the use of cookies in accordance with this policy. Users can change their cookie settings at any time in their browser or application.
Right to Terminate the Agreement
The user has the right to terminate the agreement at any time. To terminate the agreement during the beta phase, delete the user account and uninstall the application.
Language Version of Terms and Conditions
These terms and conditions are available in both Slovenian and English. Both versions have equal validity.
Recommendation to Save Terms and Conditions
We advise users to save a copy of these terms and conditions for their records. The terms and conditions in their current version are accessible on the Kucha website and through the application and can be printed or downloaded.
Out-of-Court Consumer Dispute Resolution
KUCHAAPP d.o.o. does not recognize any out-of-court consumer dispute resolution providers as competent for resolving a consumer dispute that may be initiated by a consumer under the Out-of-Court Consumer Dispute Resolution Act.
Dispute Resolution and Jurisdiction
Any disputes arising from the use of the Kucha application, these terms and conditions, or other contracts concluded with KUCHAAPP d.o.o. will be resolved amicably by the parties. If an amicable solution is not possible, the competent court in Maribor shall have jurisdiction for dispute resolution.
Slovenian law exclusively applies to these terms and conditions and all contracts concluded under these conditions, except in cases where the law provides otherwise.
Changes to Terms and Conditions
Kucha reserves the right to amend these terms and conditions. Any changes will be published in the application, and continued use of the application indicates your agreement with the amended terms.
